AI transparency notice (Article 50 of the AI Act)

This notice describes how Bonmoniq SASU complies with the transparency obligations in Article 50 of Regulation (EU) 2024/1689 on artificial intelligence (the "AI Act"), which apply from 2 August 2026, with respect to the AI voice agent offered in the Service.

It supplements the Privacy Policy and the Data Processing Agreement, to which it refers for the processing of personal data. The French-language version of this notice is the binding version.

1. Scope: an inbound-only AI voice agent

Bonmoniq's AI voice agent is designed to answer inbound calls received on the Customer's numbers. At launch it does not place automated outbound calls. When a Customer enables the feature, inbound callers may interact with a conversational AI system rather than with a natural person.

2. Informing the caller (Article 50(1))

In line with Article 50(1) of the AI Act, natural persons interacting with an AI system must be informed of that fact, unless it is obvious from the context.

Bonmoniq is designed to deliver a disclosure at the beginning of each call telling the caller that they are interacting with an artificial intelligence system. This disclosure is provided in a clear and perceptible manner at the start of the interaction.

3. AI-generated audio content (Articles 50(2) and 50(4))

The AI voice agent produces synthetic voice responses generated by artificial intelligence. Bonmoniq informs the caller that the voice is artificial as part of the disclosure described in section 2, so that AI-generated or AI-manipulated audio content is identifiable as such.

4. Self-hosted AI, no third-party AI provider

The AI voice agent runs on Bonmoniq's own infrastructure using Bonmoniq's own language models. AI conversation content is not transmitted to, or processed by, any third-party AI provider or sub-processor, and is not routed to any external AI service.

Consistent with Bonmoniq's published stance, Bonmoniq cannot guarantee complete independence from US law for the Service as a whole (see the "US providers and the CLOUD Act" section of the Privacy Policy). However, processing by the AI itself stays on Bonmoniq's own infrastructure and is not transferred to any third-party AI provider. Voice traffic for EU numbers is routed via operators established in the EU; voice traffic for US and international numbers may be handled by US operators under Standard Contractual Clauses and, where applicable, the EU-US Data Privacy Framework.

5. Reaching a human

A caller who wishes to speak to a natural person rather than the AI voice agent may request this during the call. Depending on the configuration chosen by the Customer, the call may be transferred to a natural person or, where none is available, the caller may leave a message or be called back.

The AI voice agent does not take decisions producing legal or similarly significant effects on the caller based solely on automated processing (Article 22 GDPR).

7. Customer responsibilities

A Customer that enables the AI voice agent remains responsible for its compliant use, including:

  • the lawfulness of the purposes for which it deploys the AI voice agent;
  • informing callers as required by applicable rules, in addition to the disclosure delivered by the Service;
  • complying with the consent rules applicable to call recording and transcription (see the Privacy Policy).

8. Data handling

The processing of personal data in connection with the AI voice agent, including any call recording and transcription, retention periods, legal bases, and data subject rights, is described in the Privacy Policy and governed by the Data Processing Agreement.

9. Updates

Bonmoniq may update this notice to reflect changes to the Service and to applicable legal obligations, in particular as the provisions of the AI Act become applicable.
